These Terms of Service (this "Agreement") is between you, and ZSoft AI Labs. By using our applications on phones, our websites, and/or other services we provide, you agree to be bound by this Agreement.
You're not allowed to copy, modify the app, any part of the app, or our trademarks in any way. You're not allowed to attempt to extract the source code of the app, and you also shouldn't try to translate the app into other languages, or make derivative versions.
ZSoft AI Labs is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you're paying for.
By using our service, you agree to:
- Accept that we may terminate or suspend your account if we suspect any misuse or violations
- Understand that our service is provided "as is" without guarantees or warranties
- Acknowledge we are not responsible for any losses or damages from service use
- Accept that we may update these terms at any time
Indemnification
You agree to indemnify, defend, and hold harmless ZSoft AI Labs, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of our service.
Limitation of Liability
You agree that ZSoft AI Labs will not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with your use of our service.
In particular, customer may not, and will not allow third parties (including Internal Users and End Users) to use the Products, responses created using the Products, Documentation or other data, information or service provided by ZSoft AI Labs:
- In connection with or for the purpose of operating critical infrastructure such as electrical power stations, military or defence equipment, medical appliances or other equipment whose failure or impairment would result in unforeseeable economical or physical damages
- For any illegal activities, including development of any applications infringing any third-party rights or any other applicable laws or regulations
- For spamming or any other unsolicited advertising
- To perform benchmark or other capacity testing of our products technical infrastructure
- To create a similar product, service or API whose primary purpose is to provide machine translation services, including but not limited to bilingual/multilingual dictionaries
- To develop, market or train a machine translation algorithm
- To transmit any data to ZSoft AI Labs which may not be transmitted to or processed by us due to data protection laws, contractual or statutory confidentiality obligations, export restrictions or other statutory provisions or third-party rights
Governing Law and Jurisdiction
These terms and conditions will be governed by and construed in accordance with the laws of United States or other countries including the country in which you are resident or from which you use the Services, and any disputes arising out of or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of United States.
Data Privacy
You confirm that you have read and understand our privacy policy and you give consent to the processing of your data in accordance with it.
Third-Party Services
Our service may make use of third-party technology. We are not responsible for any such third-party services, and any use of them is at your own risk.
Subscription and Refund Policy
We provide free or free trial services in the product, so we do not issue refunds once you have successfully used our product and performed certain actions, or if the purchase was made over 2 weeks ago.
If you are encountering any issues using our services, please provide the photo/video and any related evidence showing the issue, and email to contact@zsoft.ai to look into.
Waiver of Rights
ZSoft AI Labs's failure to enforce any right or provision of this Agreement will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of ZSoft AI Labs. Except as expressly set forth in this Agreement, the exercise by either party of any of its remedies under this Agreement will be without prejudice to its other remedies under this Agreement or otherwise.
Changes to These Terms
We may update these Terms from time to time. We will notify you by posting the new Terms on this page; changes take effect immediately upon posting.
